DUI/Traffic Unit

The DUI/Traffic Unit, led by Deputy District Attorney Joseph D. Lupackino, is responsible for prosecuting all driving under the influence (DUI) and traffic-related offenses in Northampton County. This includes everything from routine motor vehicle violations to serious traffic incidents resulting in death or severe injury.

First-Time Offenses: ARD Program

Individuals charged with a first-time DUI may be considered for Accelerated Rehabilitative Disposition (ARD)—a probationary program designed to offer rehabilitation and a second chance to eligible participants.

To qualify for ARD, all the following conditions must be met:

  1. No serious injuries occurred as a result of the DUI incident
  2. The individual is not considered a habitual traffic offender
  3. No passengers under the age of 14 were present in the vehicle at the time of the offense
  4. The individual has no prior DUI convictions within the past 10 years

If the participant successfully completes the ARD program, DUI charges are expunged from their criminal record.

Second-Time Offenses: ASP Program

Eligible individuals facing a second DUI charge may be admitted into the Alternative Sentencing Program (ASP), which combines accountability with treatment-focused intervention.

ASP eligibility criteria include:

  • Second Offense DUI
  • No serious bodily injury or fatality occurred

Participants in ASP are separated into two groups:

  • Group I
    • Eligibility: BAC level between .10 and .159.
    • Penalties are 5 days of incarceration, followed by 30 days of house arrest, with a maximum sentence of 6 months of incarceration.
  • Group II
    • Eligibility: BAC level .16 or greater, controlled substance, or refusal to provide BAC.
    • Penalties include 10 days of incarceration, followed by 90 days of house arrest, with a maximum sentence of 5 years of incarceration.

ASP is designed to reduce prison overcrowding while offering structured support and supervision to help individuals avoid repeat offenses.

Serious Traffic Crimes

Traffic violations involving serious bodily injury or death are handled directly by DDA Lupackino, and prosecuted to the full extent of the law. These cases often require close coordination with law enforcement agencies, accident reconstruction experts, and victim advocates.
